Terms of service

This is a draft. It still contains unfilled placeholders, it has not been reviewed by a lawyer, and it is not yet the agreement between you and Tamari.

The short version: your apps are yours, you are responsible for what you put in them, do not use Tamari for anything illegal, and we make no promise that the service will never go down.

These terms are an agreement between you and [TODO: legal entity name] (“Tamari”, “we”). By creating an account or deploying an app you accept them. If you are using Tamari for an organisation, you confirm you may accept these terms on its behalf.

What Tamari is

Tamari takes a project from your coding agent and runs it at a private HTTPS address. Your apps are private by default: nobody can open one until you share it with them.

Your account

One account per person, tied to the email address you sign in with. Keep control of that address — anyone who can sign in to it can reach your apps. Tell us promptly if you think someone else has access. You must be at least 13.

Your apps and your content

You own what you deploy. We claim no rights over your code, your data or anything your app produces. You give us only the permission needed to actually run it: storing it, building it, serving it to the people you have shared it with, and backing it up.

You are responsible for what your app does and for what it collects from the people who use it — including having the right to use whatever you deploy, and telling your own users what you do with their information.

Acceptable use

Do not use Tamari to build, host, store or distribute anything that:

  • is illegal where you are, or where the people using it are;
  • sexually exploits or endangers children, in any form;
  • is malware, a phishing page, a credential harvester, or is designed to attack or gain unauthorised access to any system, including ours;
  • sends unsolicited bulk messages, or supports doing so;
  • infringes someone’s copyright, trademark or other rights;
  • harasses, threatens, defames or incites violence against anyone;
  • is fraudulent, deceptive, or impersonates a person or organisation — including a site built to look like one;
  • mines cryptocurrency, or exists mainly to consume compute or bandwidth rather than to serve the people using it.

Also: do not attempt to break out of your app’s isolation, reach another customer’s app or data, evade quotas, or probe our infrastructure. If you find a security flaw, tell us at [TODO: abuse and legal contact address] rather than exploiting it — we will not pursue anyone who reports in good faith and gives us a reasonable chance to fix it.

An app being private does not put it outside these rules. Phishing at an address you have to be invited to is still phishing.

What happens if you break these rules

We can pause an app, which makes it unreachable while leaving it and its data intact. For something serious — anything that endangers a child, is actively attacking someone, or is plainly criminal — we may pause or remove it immediately and without notice, and we may report it to the authorities.

Otherwise we will tell you what the problem is and, where it is reasonable, give you a chance to fix it. If you think we got it wrong, write to [TODO: abuse and legal contact address] and a person will look at it.

Sharing

You decide who can open your app. You are responsible for who you invite, and for removing access when it should end. Revoking access takes effect within seconds.

Plans, quotas and payment

Plans differ in how many apps you can run and how much traffic they may serve. Current plans and prices are shown when you subscribe. Fees are charged in advance through Stripe and are not refundable except where the law requires it. You can cancel at any time and keep your plan until the period you have paid for ends.

We may change prices; if we do, we will tell you before it affects a renewal. Going over a quota may mean an app is paused until the next period or until you move to a larger plan.

Availability

We do not promise the service will be available at any particular time. Apps sleep when nobody is using them and take a moment to wake — that is how the platform keeps an idle app free to run, not a fault. We may change, suspend or discontinue parts of the service; if we discontinue something you depend on, we will give you reasonable notice and a way to get your data out.

Deleting apps and your account

You can delete an app at any time. Deleting it removes the running service, its database and its secrets. The app’s address is retired permanently and will never be given to anyone else, so a link someone saved cannot later point at a stranger’s app. What that means for the records we keep is in the privacy policy.

To close your account, write to [TODO: privacy contact address] — there is no button for it yet, and we would rather tell you that than imply one exists. We will explain what is removed and what is retained before we do anything. We may close an account that has broken these terms, or one that has been dormant for a long time, after telling you first.

Our intellectual property

Tamari — the platform, the name and the marks — remains ours. Nothing here gives you a licence to it beyond using the service as intended.

No warranty

Tamari is provided “as is”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, secure or free of errors, or that data will never be lost. Keep your own copies of anything you cannot afford to lose.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data. Our total liability arising out of these terms is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some places do not allow these exclusions, in which case they apply to you only as far as the law permits, and nothing here limits liability for death or personal injury caused by negligence, or for fraud.

Indemnity

You will indemnify us against claims, losses and costs arising from your apps, your content, or your use of Tamari in breach of these terms.

Changes to these terms

We may update these terms. If a change matters, we will tell you before it takes effect, and continuing to use Tamari afterwards means you accept it. The date at the top tells you which version you are reading.
